The controller, i.e. the entity which decides on how your personal data will be used, is TVN S.A. (hereinafter “TVN”) with its registered office in Warsaw at ul. Wiertnicza 166. TVN S.A. is one of the companies owned by Discovery Inc. based in the United States of America (hereinafter the "TVN Group").

Where does TVN have your data from?
We have received your personal data from you when you registered your TVN account as well as later during your activity on TVN websites. The information about you also comes from the cookie files collected by TVN and similar mechanisms of recording information in the devices of the website users, as long as they allow identifying you.
Moreover we receive information about you from payment operators, i.e. the entities that enable you to make online payments for services purchased from TVN. They send us information about the status of your payment for the service.
In the case of logging into the TVN account via another platform which verifies and authenticates you we receive the data from entities providing such a service, i.e. Facebook, Google or Twitter. They also provide us with the e-mail address, sex, user identifier, date of birth, automatically generated login.
What is the purpose and basis of the processing of your personal data by TVN?
TVN processes your personal data to enable you to use TVN websites, provide support for your TVN account and contact with us, to provide the functionality of services offered, in particular to solve technical problems, perform contracts concluded with you, handle complaints about the operation of TVN websites, perform duties resulting from law, including tax and accounting regulations, to enable payment for services, to monitor your activity on these websites and conduct research and analyses related to your activity as well as to conduct direct marketing activities, including those related to the organisation of competitions and promotional campaigns.
The data that identifies you may also be used to match the content and advertising displayed to your interests, to measure the quality and effectiveness of these activities, to improve the content and services provided, to inform about the content and services of TVN and of our Partners ("Partners"), the list of which is placed here, to make advertising space available on websites, to ensure the security of information processing, manage IT systems, to defend or pursue claims, as well as for statistical and archival purposes and to ensure accountability for the performance of legal obligations[find out more].
TVN is authorised to process your personal data because it is necessary to perform the contract (concluded with you by accepting regulations governing the provision of services), as well as on the basis of provisions of law, e.g. when the law requires us to process your data for tax and accounting purposes (provisions of the Tax Ordinance Act and the Accounting Act).
The legal basis for the processing of personal data is also the legitimate interest of TVN. This includes improving services, ensuring their best quality and informing users about them, providing support for your TVN account, conducting research and analyses, conducting direct marketing, protecting or pursuing claims, creating statistics and ensuring accountability. Displaying advertising tailored to your interests on websites, thanks to the automated comparison of your interests and preferences with the model interests and preferences of Internet users (profiling), allows you to cover the costs of services provided free of charge [find out more]. Do you have to provide TVN with your personal data?
Providing personal data by you is a legal requirement only to the extent resulting from the relevant tax or accounting regulations, when we settle payments received from you. Providing a name, pseudonym (nickname) and e-mail address is the requirement to conclude a contract with TVN (setting up a TVN account).
If you do not provide us with all this information about yourself, we will not be able to set up a TVN account for you, which as a result will limit your ability to use some of the TVN websites. In the remaining scope, providing data is voluntary.
What are your rights towards TVN in respect of the processed data?
You can request from TVN: access to, rectification, deletion, processing restrictions, transmission of your personal data, and not to be subject to the automated decision-making, including profiling, and you have the right to object to the processing of your personal data.
You may exercise your rights when:
- in respect of the request to rectify the data: the data is incorrect or incomplete;
- in respect of the request to delete the data: the data is no longer necessary for the purposes for which the data was collected by TVN; you will revoke your consent to data processing; you object to the processing of this data beforehand; data is processed unlawfully; the data should be deleted in order to fulfil an obligation arising from the law; or the data has been collected in connection with the provision of electronic services offered to the child;
- in respect of the request to restrict the data processing: the data is incorrect – for a period allowing TVN to check the accuracy of your data; the data is processed unlawfully, but you will not want the data to be removed; your data is no longer needed by TVN but you may need it for defending or pursuing claims; or you object to the data processing - pending the determination of whether the legitimate grounds are superior to the basis for the objection;
- in respect of the request to transfer the data:
data processing is carried out on the basis of your consent or a contract concluded with you and such processing is carried out automatically.
You are entitled to lodge a complaint regarding the processing of your personal data by TVN to the President of the Office for Personal Data Protection.
When can you object to the processing of your data?
You are entitled to object to the processing of personal data when:
- the processing of personal data takes place on the basis of a legitimate interest, or for statistical purposes, and the objection is justified by your special situation,
- personal data is processed for direct marketing purposes.
Who does TVN provide your personal data to?
In principle, TVN does not disclose your personal data to third parties, except in cases where we have a legal basis, including at the request of entities authorised by law, or when we use the services of the entities supporting TVN, e.g. entrepreneurs providing hosting of our websites and software maintenance support.
Due to the need to prevent certain functions on TVN services from Internet robots, we use the Google reCAPTCHA mechanism to sporadically investigate whether the behaviour of website users is not typical for the robotic behaviour. For this reason, TVN may disclose the IP address of your computer to Google Inc.
How long does TVN store your personal data?
TVN stores your personal data for the term of the contract concluded with you, as well as - after its completion - for the period during which the pursuit of claims in connection with the performance of the contract is possible, i.e. a maximum of 10 years from the date of the contract performance. Moreover TVN stores your data for tax and accounting purposes for a period of 5 years after the end of the year in which the financial event occurred.
TVN stores your personal data for marketing purposes for the duration of the legal basis and the purpose of data processing.
TVN stores your personal data for statistical and archiving purposes throughout the duration of the legal basis and the purpose of data processing.
Does TVN transfer your data to countries outside the European Economic Area?
Some of our service providers may store website users' data outside of the European Economic Area. In such cases, Users' data may be stored wither in countries that provide an adequate level of personal data protection or in countries that fail to do so. In the latter case, TVN secures your data by entering into the so-called Standard Contractual Clauses accepted by the European Commission, which guarantee adequate protection of Users' data in third countries, basing on the EU - US Privacy Shield program (e.g. in the case of Google reCAPTCHA) or other grounds for the transfer of personal data.
Does TVN profile your personal data or process it automatically in a way that affects your rights?
Profiling of personal data is understood as the automated processing of your data, which is based on the use of data to assess certain factors in particular to analyse or predict aspects regarding your work efficiency, economic situation, health, personal preferences, interests, credibility, behaviour, location or movement.
Based on monitoring your activity on TVN websites, we carry out analysis that result in:
b) recommending content that matches your viewing profile;
c) the transmission of advertising addressed to the groups of viewers to which you have been qualified;
d) recommending offers tailored to your viewing profile and behaviours.
However, we do not use this data for automated decision-making towards you that could affect your rights.
